A driver who struck and killed a flagger at a highway construction site in Manitoba has been found not guilty of dangerous driving causing death.

According to a report in the Winnipeg Free Press, 70-year-old Michael Blostein was found by the Queen’s Bench court to not have deviated substantially from the normal standard of care expected of motorists.

Then 21-year-old Britanny Lynn Murray was employed as a flag person for Mulder Construction, which was resurfacing part of Highway 207 between the Trans-Canada Highway and Highway 15 when the collision occurred on October 18, 2010.
